Legislative Guidance

A range of legislation exists to protect wildlife and habitats. This includes:

  • The Conservation (Natural Habitats &c) Amendment (Scotland) Regulations 2007;
  • The Conservation (Natural Habitats &c) Regulations 1994 (The Habitats Regulations);
  • EC Council Directive 92/43/EEC on the Conservation of Natural Habitats and of Wild Fauna and Flora (The Habitats Directive);
  • EC Council Directive 79/409/EEC on the Conservation of Wild Birds (The Birds Directive);
  • Nature Conservation (Scotland) Act, 2004;
  • Wildlife & Countryside Act 1981;
  • Protection of Badgers Act, 1992; and
  • Wild Mammals (Protection) Act, 1996.
HEL can provide comprehensive legislative advice regarding the above legislation, ensuring that your company stays informed of the law. HEL can also provide advice on (and facilitate) licence applications for protected species (see 'Bats and Other Protected Mammals').

Case Study: Beauly – Denny 400kV Overhead Transmission Line

HEL provided expert witness services at public inquiry for the Beauly – Denny 400kV Overhead Transmission Line. The scope of the services provided included a summary of legislation relevant to protected species, an overview of assessment methodology for protected animal species; an overview of key protected species mitigation measures; a discussion of assessed effects and whole route impacts; and rebuttals to other parties’ objections.
